The FCPA Compliance and Ethics Blog is authored by Thomas Fox who writes with a gritty, in-the-trenches, pragmatism about what is perhaps the most dangerous subject area in business today, international trade and compliance. American businesses have to live by what is arguably the toughest code of conduct in the world and can count on lofty, normative, American ideals to make competition more difficult/expensive, enhance regulatory scrutiny and expose companies and their management to heightened levels of liability.

Much of the free BigLaw material we see in this area focuses on the problems/risks/dangers of international trade without answering the critical commercial questions. The fact is that law firms will not enter this world of gray and provide you with real advice until they are engaged and their work product is protected; even then big firms often act like they wish you were not going to get on a plane and conduct business overseas.

The FCPA Compliance and Ethics Blog, however, goes beyond scare-mongering (its still pretty scary, but thats the nature of the beast) and tackles the "so what do I do?" question. It is written from an in-house perspective (by someone who knows that you are going to get on that plane whatever the business climate) and focuses on real commercial issues like assessing your prospective business partner, doing foreign diligence and drafting contracts.

When our curiosity was piqued enough by the blog posts to check out Thomas Fox's bio, we were not surprised to find that he has spent a career on the international trade front-lines (what better place to earn your stripes than with Halliburton, with or without hunting trips with the former Vice-President), culminating a lengthy in-house career as GC at a worldwide oilfield manufacturing and service company.
